Introduction

These Terms and Conditions (“Terms”) constitute a legally binding agreement between Cotswold Fine Photos (“we”, “us”, “our”) and the client (“you”, “your”) in relation to the provision of photography services booked via our website www.cotswoldfinephotos.co.uk or associated third-party platforms.

By making a booking, you confirm that you have read, understood, and agree to be bound by these Terms.

Bookings

All bookings are subject to availability and are only confirmed upon receipt of a booking fee or full payment, as specified at the time of booking.

We utilise a third-party booking platform (Pixieset) to manage scheduling and client communications. By booking through this platform, you also agree to Pixieset’s applicable terms and policies.

Payments

Payments are processed securely via Stripe, a third-party payment processor.

A non-refundable booking fee may be required to secure your session date
The remaining balance must be paid in accordance with the terms agreed at the time of booking
No images or deliverables will be provided until full payment has been received and cleared

We reserve the right to cancel or withhold services where payment obligations are not met.

Cancellations & Rescheduling

Booking fees are strictly non-refundable
You may request to reschedule your session by providing at least 48 hours notice, subject to availability
Requests made with less notice may result in forfeiture of the booking fee

In exceptional circumstances (including illness or events beyond reasonable control), we may, at our discretion, offer an alternative date.

We reserve the right to cancel or reschedule a session due to circumstances beyond our control, including but not limited to adverse weather, illness, or equipment failure. In such cases, we will offer a rescheduled session or refund any payments made, excluding any non-recoverable costs.

Late Arrivals

You are responsible for arriving on time for your scheduled session.

Late arrival may result in a reduced session duration
If you are more than 30 minutes late without prior communication, the session may be deemed cancelled and no refund will be issued

Image Delivery

Edited images will be shown to you during a Teams video call
Delivery times are estimates only and are typically within 3 weeks of your session, but may vary depending on workload and circumstances
Final image selection, editing style, and artistic direction remain at our sole discretion

We shall not be liable for delays caused by factors outside our reasonable control.

Copyright and Licence

All images produced remain the intellectual property and copyright of Cotswold Fine Photos in accordance with the Copyright, Designs and Patents Act 1988.

Upon full payment, you are granted a non-exclusive, non-transferable licence for personal use only. This includes:

Downloading and printing images
Sharing images on personal social media platforms (credit is appreciated but not mandatory)

You must not:

Sell, license, or commercially exploit the images
Edit, alter, or apply filters to the images without prior written consent

Commercial usage requires a separate written agreement and may incur additional fees.

Model Release and Image Use

By participating in a photography session, you grant Cotswold Fine Photos a perpetual, worldwide, royalty-free licence to use, reproduce, and display images in which you appear for the purposes of:

Portfolio display (including website and galleries)
Social media promotion
Marketing, advertising, and promotional materials

This consent applies unless you explicitly withdraw permission in writing prior to or at the time of the session.

Where the subject is under 18 years of age, consent must be provided by a parent or legal guardian.

You retain the right to withdraw consent for future use at any time by contacting us in writing; however, this will not apply retrospectively to materials already published.

Liability

We shall exercise reasonable skill and care in the provision of our services. However, to the fullest extent permitted by law, we shall not be liable for:

Any indirect, incidental, or consequential loss or damage
Injury, loss, or damage arising from circumstances beyond our reasonable control
Weather-related disruptions affecting outdoor sessions
Loss or damage to personal property during the session

Our total liability shall not exceed the total amount paid by you for the services.

Nothing in these Terms shall limit or exclude liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Personal Data and Privacy

We process personal data in accordance with our Privacy Policy, which is available on our website.

Your data may be processed for the purposes of:

Managing bookings and communications
Delivering services and image galleries
Processing payments via Stripe
Improving our website and services (subject to your consent via our cookie banner)

We use cookies and similar technologies in accordance with our cookie policy. Non-essential cookies (including analytics and marketing cookies) are only activated with your consent via our cookie banner.

By using our website and services, you acknowledge that your data may be processed by third-party providers including Pixieset and Stripe, in accordance with their respective privacy policies.

Changes to Terms

We reserve the right to amend these Terms at any time. Updated versions will be published on our website and will take effect immediately upon publication.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
